How XFoil CEO Paul Stopped the eFoil Ban: Saving American Waters from Overreach

If you are riding an eFoil anywhere in the United States today, there is a single, overlooked reason your board hasn't been reclassified, banned, or slapped with crippling regulatory penalties like we've seen in Canada and parts of Europe.

It didn't happen by accident. And it certainly didn't happen because of the legacy eFoil community.

It happened because Paul Lowchareonkul, CEO of XFoil and PLX Devices Inc., stepped into the political arena, confronting regulators and federal oversight bodies in to kill sweeping restrictions before they could metastasize into national policy.

The Hawaii Threat & The Federal Domino Effect

When regulatory proposals including bills like SB627, SB2209, and HB1878—surfaced in Hawaii, a local group of Hawaiian riders fought back tirelessly. But they were fighting an uphill battle, barely eking by with a single vote or two during early committee stages. The sport was on the absolute brink of an absolute ban.

Had these measures passed, eFoilers today would be corralled into designated zones, effectively cutting off access to more than 99% of American waters.

What legacy manufacturers failed to grasp was the massive structural threat: Hawaii is a primary testing ground for maritime policy.

Because of the close, direct relationship between the Hawaii Division of Boating and Ocean Recreation (DOBOR) and the United States Coast Guard (USCG), regulatory precedents established in Hawaii carry immediate national weight. Had Hawaii succeeded in reclassifying eFoils as "thrill craft" (grouping them with personal watercraft/jet skis) or banning them outright under the guise of localized noise and marine safety concerns, the U.S. Coast Guard was positioned to adopt those exact classifications and restrictions across the rest of the continental United States.

A single legislative failure in Hawaii would have triggered an unstoppable domino effect, shutting down waterways, imposing severe operational bans, and crippling eFoiling across every state line.

Uniting the Community: Rallying the People to Stop the Ban at the Source

While legacy brands sat back content to protect their bloated $12,000+ price tags and artificial profit margins Paul Lowchareonkul recognized this danger and took decisive action.

To give riders a unified, unassailable voice, Paul established the Official Hawaii eFoil Association.

By building an official platform dedicated to protecting rider rights and promoting responsible ocean safety, Paul rallied the people, mobilized technical data, dismantled false narratives surrounding underwater motor noise, and proved to lawmakers that direct-drive electric propulsion systems satisfy standard motorized vessel requirements without requiring aggressive new bans.

When Paul and the Hawaii eFoil Association stepped in to lead the opposition, the political landscape flipped entirely.

The official testimony submitted to the state legislature transformed into a massive, record-breaking landslide: public response killed the thrill-craft reclassification and ban by a staggering 193 to 1 margin.

We didn't just win a local fight—we stopped the national eFoil ban at its source. As confirmed in legislative records, the restrictive measures were deferred and died in committee. Furthermore, official Hawaii DLNR / DOBOR Guidance permanently solidified eFoils as standard motorized vessels—neutralizing the federal threat at its origin and preserving the freedom of flight for riders across the entire United States.

Greed, Manufactured Hysteria, and the Legacy Community

Let’s be completely candid: The legacy eFoil community has been targeted by corporate greed and manufactured narratives.

For years, legacy manufacturers have treated eFoiling as an exclusive playground for the ultra-wealthy, charging massive luxury markups on outdated technology while attacking innovators. When XFoil stepped in to make innovative high-performance eFoiling accessible, the legacy establishment didn't welcome innovation they launched petty attacks.

Despite saving the American eFoil market from regulatory shutdown, Paul Lowchareonkul and XFoil face an ungrateful legacy community that would rather protect their $14,000 retail margins than celebrate the growth of the sport.

The Mission: A Free Ride for Everyone

Every rider deserves to take to the water without paying an arbitrary $10,000 mark-up to greedy middlemen and gatekeepers.

  • Freedom on the Water: Ride freely on public waters without being targeted by overreach or corralled into restrictive zones.
  • No Luxury Tax: Access cutting-edge engineering—including direct-drive motors and active wing stabilization—at a fair price.
  • A Growing Sport for Everyone: Lowering the barrier to entry makes the sport accessible to everybody, not just the wealthy—and when accessibility grows, the entire eFoil ecosystem wins.

Paul Lowchareonkul and XFoil fought the political battles so that riders across America could keep their freedom. You're welcome, eFoil community.

While the legacy efoil communities largely remain short sighted, we will keep building, innovating, and defending your right to a free, affordable ride.
