Privacy Policy

PLX Devices Inc. (“PLX,” “we,” “us,” or “our”) is committed to protecting your privacy and engineering exceptional, secure digital experiences across our websites, direct-to-consumer online platforms, mobile applications (“Apps”), and hardware firmware ecosystems.

This Privacy Policy explains how we collect, use, disclose, and safeguard your information when you visit our websites, utilize our hardware companion software, or purchase our products. By accessing our websites or using our Apps, you agree to the collection and use of information in accordance with this policy.

1. Information We Collect

We collect several types of information from and about users of our websites and Apps, including:

  • Personal Identifiers: Information you knowingly and voluntarily choose to disclose to us, including your name, shipping address, billing address, email address, phone number, and account credentials.
  • Device and Technical Data: Information automatically collected from the hardware or software you use to access our services, including your Internet Protocol (IP) address, Media Access Control (MAC) address, browser type, operating system, device identifiers, and crash/diagnostic logs.
  • Commercial Information: Transaction histories, products viewed, cart additions, and order details derived from your interactions with our direct-to-consumer storefronts.
  • Geolocation Data: Precise or approximate geolocation of your mobile device, utilized strictly to facilitate localized software functionalities (such as geofencing, local environmental calibrations, or hardware synchronization), subject to your device’s permission settings.

2. How We Collect Data (Cookies, Beacons, and Analytics)

PLX utilizes automatic data collection tools, including cookies, web beacons, embedded web links, and clear GIFs, to monitor traffic patterns, enhance website utility, and optimize marketing campaigns.

  • Third-Party Analytics: We utilize third-party tools, including Google Analytics, to analyze audience size, demographic trends, and usage patterns. To opt out of Google Analytics tracking, you may install the Google Analytics Opt-out Browser Add-on available at https://tools.google.com/dlpage/gaoptout.
  • Do Not Track Signals: Your web browser may feature a “Do Not Track” (DNT) setting. Because there is currently no industry-standard framework for recognizing these signals, PLX websites and online services do not alter their processing behavior in response to a DNT signal.

3. Use and Processing of Information

PLX processes your data under valid legal bases to fulfill our business objectives, including:

  • Processing, fulfilling, and shipping orders, managing accounts, and generating quotes.
  • Customizing, diagnostic testing, and optimizing the features, stability, and performance of our hardware and Apps.
  • Delivering digital advertising, promotional newsletters, and targeted marketing campaigns (subject to your right to object or opt out).
  • Data Ownership and Commercial License: Except as limited by applicable data protection laws (such as CCPA or GDPR), any technical data, feedback, product reviews, or non-personal information submitted to PLX becomes the property of PLX. For personal data submitted, you grant PLX a perpetual, worldwide, royalty-free license to record, compile, and utilize such information to maintain, improve, and secure our services.
  • No Selling of Personal Information: PLX does not sell, rent, or lease your personal identifiers to third parties for their own independent marketing or commercial gain.

4. Sharing and Disclosure of Information

We may share your information on an aggregated or individual basis with third parties strictly in furtherance of our operational business needs, including:

  • Service Providers: Trusted third-party vendors, cloud infrastructure hosts, analytics providers, and payment processors (who process credit card payments securely under strict PCI-DSS compliance standards without PLX storing raw financial credentials).
  • Corporate Affiliates: Other PLX group companies or subsidiaries in accordance with applicable data protection regulations.
  • Legal Compliance and Protection: We reserve the right to disclose personal information if required to do so by law, subpoena, or legal process, or if we hold a good-faith belief that such action is necessary to comply with judicial mandates, protect and defend the rights or property of PLX Inc., or protect the personal safety of our users or the public.
  • International Data Transfers: If you are located within the European Union (EU), European Economic Area (EEA), or United Kingdom (UK), your data may be transferred to and processed in countries outside the EEA (including the United States). PLX ensures all such transfers comply with approved legal transfer mechanisms, such as Standard Contractual Clauses (SCCs).

5. Email Communications and Opt-Out Rights

You may receive transactional or promotional emails from PLX. To cease receiving electronically initiated promotional communications, you may click the "UNSUBSCRIBE" link embedded at the bottom of any marketing email. Following an unsubscribe request, your email will be promptly removed from our marketing distribution lists. Transactional emails regarding active orders, shipping confirmations, and product safety notices will continue to be sent as necessary to fulfill our ongoing consumer obligations.

6. Specific App Permissions and Device Access

Our specialized hardware companion Apps may require the following background permissions to function correctly:

  • Location & Geofencing: Used to establish initial setup configurations or activate localized operational automation scenes based on your device's proximity.
  • Background App Refresh: Periodically connects to authorized hardware systems when the app is idle to deliver real-time system diagnostics and telemetry updates.
  • Photos, Media, and Diagnostic Files: Our Apps log troubleshooting diagnostics locally. If you execute a "Send Feedback" command, these anonymized diagnostic logs are transmitted to our engineering team for analysis. Our software does not access your personal images, videos, or external media files.

7. Data Security Disclaimer

PLX employs robust industry-standard encryption protocols (such as Transport Layer Security/HTTPS) to protect data during transmission. However, no method of transmission over the Internet or electronic storage is 100% secure. While we strive to protect your personal information, you acknowledge that you disclose information online to us at your own risk.

8. Children’s Privacy

PLX websites, software, and hardware ecosystems are not directed to or intended for use by minors under the age of 13. We do not knowingly collect or solicit personal information from children under 13. If we discover that a child under 13 has provided us with personal identifiers, we will delete that information immediately from our servers.

9. Regional Privacy Rights (CCPA/CPRA and GDPR)

Depending on your jurisdiction (such as California or the EU), you may possess specific legal rights regarding your personal data under the California Consumer Privacy Act (CCPA/CPRA) or General Data Protection Regulation (GDPR). These rights include:

  • The Right to Know/Access: The right to request disclosure of the specific categories and pieces of personal data we have collected about you.
